1. What Hero Pay is
Hero Pay compares your paycheck against your collective bargaining agreement. You provide your contract, pay rates, hours, and paystub; Hero Pay applies the contract rules and produces a draft report identifying lines that appear to differ from what the contract requires.
Hero Pay produces a draft for your review. It does not file anything, contact your employer, or act on your behalf.
2. Not legal or financial advice
Hero Pay is a calculation tool, not a law firm, labor representative, or financial advisor. Nothing it produces is legal advice.
Contract interpretation involves judgment. Hero Pay applies rules as extracted and configured — it does not resolve ambiguity, and it does not know about side letters, past practice, grievance settlements, arbitration awards, or verbal agreements that may govern how a provision is actually applied.
Verify anything Hero Pay tells you against your official paystub, and talk to your union representative before acting on it.
3. You verify the output
Hero Pay's accuracy depends on whether your contract was extracted correctly, whether the rates entered are right for your classification and period, whether the hours you entered are accurate, and whether your paystub was read correctly. Any of these can be wrong.
Reports may mark lines as unverified, informational, or manually entered. Those labels are part of the report — do not remove them. Review every figure before relying on it or sending it to anyone.
4. What you may not do
Submit a report without verifying it. Alter a report to remove warnings or unverified-line labels and present it as Hero Pay output. Upload another person's pay information without permission. Use Hero Pay to harass, defraud, or make knowingly false claims. Attempt to access other users' data or circumvent access controls. Resell or commercially redistribute Hero Pay or its output.
5. Accounts
You need an account. You are responsible for your credentials and for activity under your account. We may suspend accounts for violation of these Terms.
6. Department configuration is shared
Contract rules, paystub label mappings, and pay rate tables are stored per department so members don't each configure from scratch. This information is shared with other members of your department. Do not enter personal information into department configuration fields.
Your paystub data, hours, and reports are not shared with other members.
7. No warranty
Hero Pay is provided "as is" and "as available," without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that Hero Pay will be error-free, that its calculations will be correct, or that it reflects your contract or applicable law. Wage and hour law, including the FLSA and its 7(k) exemption, is complex and changes, as do collective bargaining agreements.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost wages, lost benefits, missed deadlines, or employment-related harm arising from your use of Hero Pay — including harm from an incorrect report, a missed underpayment, a false finding, or any action taken or not taken based on its output.
Our total liability for any claim will not exceed the greater of what you paid us in the preceding twelve months or one hundred dollars ($100).
9. Grievance deadlines are yours
Collective bargaining agreements impose strict deadlines for raising pay disputes. Hero Pay does not track, calculate, or warn about any deadline. Missing one can permanently forfeit your claim. Confirm timelines with your union representative.
10. Trial use
Hero Pay is in limited trial. Features may change or break, and data may be reset. Treat output as provisional.
11. Intellectual property
Hero Pay's software, calculation engine, interface, and documentation are ours and protected by copyright. You get a limited, personal, non-transferable license to use Hero Pay to audit your own pay. Your contract, paystubs, and pay information remain yours, as do the reports generated for you.
12. Changes and termination
We may update these Terms; material changes will be posted with a revised date. Continuing to use Hero Pay means you accept them. You may stop using Hero Pay any time; we may discontinue it any time. Sections 2, 3, 7, 8, 9, and 11 survive.
13. Governing law
California, without regard to conflict of laws provisions.
